1. Ownership of Copyright
In accordance with the Australian Copyright Act 1968, the Photographer (the "Creator") retains full and exclusive copyright of all images taken during the session. This includes the right to use, reproduce, and publish the images for portfolio, marketing, and promotional purposes.
2. Client Usage License
Upon full payment, the Client is granted a non-exclusive, personal-use license.
You May: Share images on personal social media, create prints for home display, and share with family.
You May Not: Sell the images to third parties, enter them into competitions, or use them for commercial/business branding without prior written consent and a separate commercial license agreement.
3. Model Release (Including Minors)
By booking this session, the Client (or Parent/Guardian) grants the Photographer the irrevocable right to use the images for:
Professional portfolio and website display.
Social media marketing (Instagram, Facebook, etc.).
Photographic exhibitions or editorial publications.
Privacy Option: If you require certain images to remain private for safety or personal reasons, this must be requested in writing prior to the session.
4. Safety & Parental Supervision
For all sessions involving minors:
A parent or legal guardian must be present at all times.
The Photographer holds a valid Queensland Blue Card (Working with Children Check).
The Photographer reserves the right to terminate a session immediately if the environment is deemed unsafe or if the behaviour of any party is inappropriate.
5. Creative Integrity
The Client agrees that they have hired the Photographer based on their specific style and "foundational mastery" of the craft.
No Re-Editing: The Client shall not apply "filters" or alter the images (cropping, colour changes) in a way that misrepresents the Photographer’s original work.
Moral Rights: The Photographer asserts their right to be attributed as the author of the work.
6. Limitation of Liability
While every care is taken (including the use of professional-grade equipment and underwater housings where applicable), the Photographer’s liability for any loss, injury, or equipment failure is limited to a full refund of the session fee.
